 FRAMEWORK AGREEMENT

PROVISION OF LEGAL ASSISTANCE TO LAND REFORM PROJECTS

GENERAL REQUIREMENTS

The works, as described, requires the services of professional service providers in the categories of skills and knowledge as specified below. This assignment will be in terms of a framework agreement entered into and a service level agreement will be signed with the service provider for a period of 36 months.

Casidra renders project management service to Departments within the Western Cape Government (WCG), local authorities, businesses, non-governmental organizations (NGO’s) community-based organizations (CBO’s), academic institutions, other governmental agencies and international assistance institutions. As the official implementing agent for the Western Cape Government, development projects are planned and implemented by Casidra. Its proven ability and skills, ground level involvement in communities, proven track record and sound financial record-keeping, reporting and auditing make Casidra the preferred implementing agent.

The area of operation of Casidra is the whole of the Western Cape. 

Casidra needs to appoint a legal service provider(s) to undertake legal assignments within projects. This service is needed as Casidra does not have an in-house legal department that would be available when needed. 

Casidra Head Office is in Paarl and a regional office is in George. Preferably the service provider must have an office representation in or close to these centres.

The successful service provider(s) must be available as and when needed throughout their time of appointment. The contract period will be for a period of 36 months and will be in the form of a Framework Agreement, with a provision for fees adjustment in the second and third years, should there be a need.

The possible activities for the legal service provider(s) would be, but may not be limited to the following scope of works:

  • Representation of projects in legal disputes
  • Litigation in lower courts on behalf of the client should there be a need
  • Conducting mediation/arbitration
  • Debt collection
  • Drafting and scrutinizing of contractual agreements
  • Provision of legal opinion on various issues concerning Casidra’ s business
  • Conducting mediation for farmer beneficiaries, should that be required
  • Scrutinizing and compiling of a report on the compliance of, and validity of shareholders agreements, lease agreements in accordance with CASP funding guidelines and make recommendations to changes in the best interest of beneficiaries
  • Drafting of specific undertaking agreements on a demand basis
  • Resolving water rights for farmers

In accordance with Casidra’s Preferential Procurement Policy, this bid as further indicated in CBD 5.1 is subject to: 

  • The successful bidder will be required to fill in and sign a Service Level Agreement (CPBD 8)

BID DEADLINE:  The closing date for the bid is 04 August 2023 strictly at 12H00.

SUBMISSION OF BIDS 

Bids must be submitted in a sealed envelope with the name of the bidder and the inscription “PROVISION OF LEGAL ASSISTANCE TO LAND REFORM PROJECTS – 09/2023” and placed in the bid box available at Reception of Casidra’s Head Office, 22 Louws Avenue, Southern Paarl.  No faxed, emailed, counter-to-counter courier or posted bids will be accepted.

The following documents (including fully completed and signed CPBD forms numbered 1 to 5.1 as supplied) must be valid for a period of 90 calendar days after closure of the bid and submitted as a bid packet:
